By creating an account and using the Pokesuta (“we,” “us,” or “our”) digital pass platform, you (the “Merchant,” “Client,” or “you”) agree to be bound by these Terms of Service. If you do not agree, do not use the service.
Pokesuta provides a software-as-a-service (SaaS) platform allowing merchants to design, generate, and distribute digital loyalty cards, coupons, and passes compatible with Apple Wallet and Google Wallet.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, POKESUTA AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY ISSUES ARISING FROM APPLE INC. OR GOOGLE LLC REJECTING, SUSPENDING, OR REVOKING YOUR DIGITAL PASSES OR WALLET CERTIFICATES.
Pokesuta relies on third-party infrastructure (Apple Wallet and Google Wallet). We do not guarantee uninterrupted functionality if Apple or Google changes their policies, APIs, or revokes developer certificates. You agree to comply with Apple’s and Google’s respective Terms of Service for Wallet developers.
The Service is provided “AS IS” and “AS AVAILABLE” without warranty of any kind. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
These Terms shall be governed and construed in accordance with the laws of [Insert Jurisdiction/Country], without regard to its conflict of law provisions.
