1. Acceptance of Terms

By creating an account and using the Pokesuta (“we,” “us,” or “our”) digital pass platform, you (the “Merchant,” “Client,” or “you”) agree to be bound by these Terms of Service. If you do not agree, do not use the service.

2. Description of Service

Pokesuta provides a software-as-a-service (SaaS) platform allowing merchants to design, generate, and distribute digital loyalty cards, coupons, and passes compatible with Apple Wallet and Google Wallet.

3. Merchant Responsibilities & Compliance

  • Data Controller: You acknowledge that you are the Data Controller of all personal data collected from your end-customers (“Consumers”) via our platform. Pokesuta acts solely as a Data Processor.
  • Consumer Consent: You are strictly responsible for obtaining legally valid consent from Consumers before collecting their data (e.g., email, name) and before sending them marketing communications or push notifications via our platform.
  • Privacy Policy: You agree to maintain and display your own legally compliant Privacy Policy to your Consumers.
  • Prohibited Content: You may not use Pokesuta to distribute malicious, fraudulent, offensive, or illegal content. We reserve the right to suspend accounts violating this rule without notice.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POKESUTA AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY ISSUES ARISING FROM APPLE INC. OR GOOGLE LLC REJECTING, SUSPENDING, OR REVOKING YOUR DIGITAL PASSES OR WALLET CERTIFICATES.

5. Apple & Google Ecosystems

Pokesuta relies on third-party infrastructure (Apple Wallet and Google Wallet). We do not guarantee uninterrupted functionality if Apple or Google changes their policies, APIs, or revokes developer certificates. You agree to comply with Apple’s and Google’s respective Terms of Service for Wallet developers.

6. Service Availability & “As-Is”

The Service is provided “AS IS” and “AS AVAILABLE” without warranty of any kind. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

7. Account Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Insert Jurisdiction/Country], without regard to its conflict of law provisions.
